The basis for the court's decision was a violation of the requirements of Art. 9 of the Law of 08.08.2001 No. 134-FZ. In particular, the inspection was carried out by persons other than those indicated in the order to carry out the control measure.

By decision of the Arbitration Court of the Moscow Region dated September 30, 2005 No. A41-K2-17927/05, the decision of the State Technical Supervision Authority to bring the organization to administrative liability in the form of a fine of 30,000 rubles for non-compliance with territorial construction standards was declared illegal.

The court decision was made due to the fact that Gosadmtekhnadzor monitors compliance with the rules for ensuring cleanliness, order and improvement in the Moscow region, and this violation is beyond its competence.

Examples show that Law No. 134-FZ provides organizations with effective tools to protect rights. One of these tools is the “Register of activities for control of legal entities and individual entrepreneurs”, regulated by Article 9 of the Law. • Resolution of the State Standard of the Russian Federation dated 01.09.03 No. 99 “On approval of the procedure for conducting state control and supervision by the State Committee of the Russian Federation for Standardization and Metrology”, paragraph 17;
• Order of the Ministry of Health of Russia dated July 17, 2002 No. 228 “On the procedure for carrying out control measures during the implementation of state sanitary and epidemiological surveillance”, paragraph 22.

An organization can develop the form of the journal independently, guided by the requirements of the Law.
The journal must be numbered, stitched and stamped. Competent and accurate maintenance of the “Logbook of activities for the control of legal entities and individual entrepreneurs” is not mandatory, but it is necessary for the organization itself, as it protects its rights. Filling out the log will reduce the number of illegal checks and, in addition, will help in asserting your rights in court.

By order of management, it is necessary to approve instructions for interaction with controllers. In the instructions, the manager records his instructions to employees about the rules of conduct during inspections. In particular, it can be written there that all personnel can be involved in the inspection only with the consent of management. A separate order approves the list of authorized management representatives who can represent the organization during the inspection. It is worth adding a clause to the instructions stating that ordinary employees (not officials) are prohibited from having conversations and answering questions from supervisors; the manager has the legal right to include such clauses. 3. A planned control event can be carried out by each state control body no more than once every two years in relation to one legal entity, and the duration of the inspection should not exceed 30 days. In relation to a small business entity, a planned control measure can be carried out no earlier than three years from the date of its state registration.

During an unscheduled inspection, the subject of the inspection must be clearly indicated.

Representatives of organizations have the right to be directly present during control activities, get acquainted with the results of inspections, give explanations and indicate in the reports information about their familiarization, agreement or disagreement. If an official of the organization does not agree with the document drawn up by the inspectors, when signing, you can make a note “disagree” or sign only when it was received (i.e., do not specify your disagreement, and subsequently adjust your position on this issue with a lawyer in a calm atmosphere ). 6. The law establishes:

• the inadmissibility of control bodies collecting fees from organizations for carrying out control activities, except in cases of reimbursement of expenses for carrying out research and examinations;
• the inadmissibility of receiving funds directly by inspectors in cases of drawing up reports of administrative violations.

7. Legal entities have the right to appeal against the actions (inactions) of officials of state control bodies in administrative and (or) judicial proceedings in accordance with the legislation of the Russian Federation.
During inspections there is a presumption of good faith, i.e. for those being inspected, the rule “everything that is not prohibited is permitted” applies; for the inspector, on the contrary, “everything that is not permitted is prohibited” (all actions require special permission).
